4. Quotes and Estimates

All quotes are provided based on the information available at the time, including customer details, site measurements, access conditions, product selection, and project requirements.

A quote may be subject to change if additional work is required, site conditions differ from what was originally advised, measurements or specifications change, or the customer requests variations.

PHONPA Australia will make reasonable efforts to inform the customer of any changes to pricing or scope before proceeding with additional work.

5. Customer Responsibilities

Customers must provide accurate information about the project, property, access, measurements, existing fixtures, and any known issues that may affect the work.

Customers are responsible for ensuring that PHONPA Australia has safe and reasonable access to the site at the agreed time. This includes securing pets, clearing work areas where possible, and advising of any hazards.

Where approvals, permits, body corporate approvals, landlord permissions, or building management approvals are required, the customer is responsible for obtaining them unless otherwise agreed in writing.

6. Booking, Scheduling, and Site Access

Installation dates and project timelines are provided in good faith and may be affected by weather, product availability, supplier delays, site conditions, access issues, or other circumstances outside our reasonable control.

PHONPA Australia will make reasonable efforts to complete work within the agreed timeframe, but we do not guarantee completion dates unless expressly confirmed in writing.

If the customer fails to provide access at the agreed time, a rescheduling fee or additional charge may apply.

7. Products, Materials, and Availability

Products and materials may vary depending on supplier availability, specifications, measurements, project requirements, and customer selections.

If a selected product becomes unavailable, PHONPA Australia may recommend a suitable alternative. Any major change in product type, price, or project scope will be discussed with the customer before proceeding.

8. Installation Work

PHONPA Australia will perform installation services with due care, skill, and professional workmanship.

Customers acknowledge that installation work may involve drilling, removal of existing fixtures, minor surface disturbance, noise, dust, or temporary disruption. PHONPA Australia will take reasonable care while working on site, but customers should remove fragile, valuable, or obstructive items from the work area before installation begins.

9. Removal of Existing Windows or Doors

Removal of old windows, doors, frames, fittings, or related materials will only be included if stated in the quote or agreed in writing.

Additional charges may apply where removal is more complex than expected, involves hidden damage, requires additional labour, or requires special disposal.

10. Payment Terms

Payment terms, deposit requirements, progress payments, and final payment due dates will be stated in the quote, invoice, or written agreement.

The customer agrees to pay all amounts due by the due date. PHONPA Australia may pause or delay work if payments are not made in accordance with the agreed terms.

Any overdue amounts may be subject to reasonable recovery costs, administration fees, or legal collection costs where permitted by law.

11. Cancellations and Changes

Customers must notify PHONPA Australia as soon as possible if they wish to cancel, reschedule, or change a booking or approved project.

Cancellation fees may apply where materials have already been ordered, custom products have been prepared, labour has been scheduled, or work has commenced.

Custom-made, specially ordered, or made-to-measure products may not be refundable simply because the customer changes their mind, subject to rights under Australian Consumer Law.

12. Variations to Work

Any changes to the agreed scope, products, measurements, installation requirements, site access, or project timeline may result in additional charges.

PHONPA Australia may require written approval before proceeding with variations. This helps ensure both parties understand the updated scope, cost, and expected timeline.

13. Warranties and Workmanship

PHONPA Australia may provide warranty-backed workmanship as stated in the relevant quote, invoice, or written agreement.

Any warranty offered by PHONPA Australia is in addition to any rights and remedies that may apply under Australian Consumer Law.

Warranties may not apply to damage caused by misuse, neglect, unauthorised repairs, structural movement, water damage, accidental damage, extreme weather, lack of maintenance, or issues caused by third parties.

14. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot be excluded under Australian Consumer Law.

Where services fail to meet applicable consumer guarantees, customers may be entitled to a remedy under Australian Consumer Law. Where goods or services have a major problem, customers may have additional rights.

PHONPA Australia will handle valid concerns fairly and in accordance with applicable law.

15. No Guarantee of Specific Outcomes

PHONPA Australia aims to provide high-quality products and installation services. However, we cannot guarantee outcomes that depend on factors outside our control, including existing building condition, structural issues, surrounding noise levels, energy use habits, weather exposure, product limitations, or third-party work.

Soundproof and insulated products may reduce noise transfer or improve comfort, but results can vary depending on the property, surrounding environment, installation conditions, and selected product.

To the maximum extent permitted by law, PHONPA Australia will not be liable for indirect, incidental, special, or consequential loss, including loss of profit, loss of business, loss of opportunity, or inconvenience arising from use of the website or engagement of our services.

22. Safety and Site Conditions

Customers must inform PHONPA Australia of any known risks, hazards, asbestos concerns, electrical issues, structural concerns, or other matters that may affect safety or installation.

23. Termination of Services

PHONPA Australia may terminate or suspend services if the customer fails to make payment, provides false or misleading information, denies reasonable access, behaves abusively toward staff or contractors, or breaches these Terms and Conditions.

The customer remains responsible for payment for work completed, materials ordered, and reasonable costs incurred up to the date of termination.

24. Dispute Resolution

If a dispute arises, both parties agree to first try to resolve the matter through good faith communication.

Customers should contact PHONPA Australia with details of the issue, including photos or supporting information where relevant. We will review the matter and aim to respond within a reasonable timeframe.

If the dispute cannot be resolved directly, either party may seek assistance from a relevant consumer affairs body, tribunal, mediation service, or court with jurisdiction.
